On November 1, 2011, Gregory Yount, of the Northern Arizona Uranium Project, LLC, filed a suit against Secretary of Interior Ken Salazar and the BLM for refusing to, among other things, compose and publish a supplemental Draft Environmental Impact Statement (“DEIS”) to the Northern Arizona Proposed Withdrawal (“NAPW”) DEIS addressing and incorporating new information provided by the public during the public review period of the initial NAPW DEIS. Judge Frederick Martone in the US District Court for the District of Arizona, Prescott Division, has been assigned to consider Mr. Yount’s complaint. On November 5, 2011, Mr. Yount filed a motion for preliminary injunctive relief prohibiting Secretary Salazar from deciding whether or not to withdraw the federal lands concerned for a 20-year period until the BLM and Secretary Salazar answer Mr. Yount’s complaint and Judge Martone has decided the matters at hand.

Details regarding Mr. Yount’s suit can be obtained from the NAU Project website at http://www.northern-arizona-uranium-project.com/support_federal_lawsuit
